New Mexico smart meter court case could set a precedent for the world
Fortunately, it’s never too late to stop a slow-moving disaster. And here we are.
"The Public Regulation Commission’s complete refusal to evaluate the health and environmental effects of smart meters is unlawful, unjust, and unreasonable. The Commission’s threat to fine NMUS (New Mexicans for Utility Safety) up to $100,000 for continuing to urge the Commission to fulfill its mandate to protect the public health and welfare is likewise unlawful, unjust, and unreasonable."
Motion of Rehearing, Arthur Firstenberg
How well do you know ‘safe and effective’ SMART meters?
I happened to be outside on the front verandah when a man dressed in a tradesman type of uniform knocked on the door of my elderly neighbour. I overheard him telling her that he would be turning off her electricity for a short time so he could install new electricity meter. ‘It’s just an upgrade,’ he said.
My neighbour thought nothing of it and allowed him to do the work. I knew straight away that he was installing a SMART meter and mentioned it to my partner, who let the tradesman know that there will be no smart meter installed on his property.
Our neighbour would have no idea about the court case in New Mexico that is challenging the safety of smart meters, or the hundreds of testimonials worldwide about negative health impacts post-installation. She is quite frail these days and grieving the loss of her husband and son, so I will share my concerns with one of her family members next time they visit. Then they can do their own research and make up their own minds.
Most Australian councils are in lockstep with SMART cities and all the harmful trimmings. Most freemasons are blind followers - anything for power and control. Even if it means harming community health and wellbeing.
If you have been feeling unwell, sleepless or manifesting symptoms of illness, please consider the possibility of being affected by Radiofrequency Microwave Radiation Emissions from Smart Meters. (Testimonies from around the world appear toward the end of this article.)
SMART - Self Monitoring Analysis and Reporting Technology
Many Australians are still not aware of the WEF (World Economic Forum) or the SMART surveillance system.
SMART - Self Monitoring Analysis and Reporting Technology
Original meaning of smart = pain.
This strange surveillance system concept stems from the World Economic Forum, founded on January 24, 1971, by German engineer Klaus Schwab who was raised in a world where Nazi ideologies reigned supreme. Initially named the European Management Forum, it was renamed the World Economic Forum in 1987.
The WEF holds annual meetings in Davos Switzerland every January. There are two meetings. According to the Global Intelligence Agency report by Kim Goguen, the first meeting is a private affair attended by operatives that plan the months ahead and tell politicians what to do. The second meeting is publicized and attended by politicians, business people and others who have vested interests in how the world is managed (or messed up).
The Australian population can thank former masonic Prime Minister Malcolm Turnbull for signing the country away without our consent to the SMART cities program. Fortunately, it’s never too late to stop a slow-moving disaster.
And here we are.

Smart Meter Court Case in New Mexico, January 2025
Arthur Firstenberg is the president of the Cellular Phone Task Force and has been writing about the dangers of wireless tech and electromagnetic radiation for decades. He is the author of Invisible Rainbow: A History of Electricity and Life and The Earth and I and a passionate advocate of healthy families and a healthy environment. Unfortunately, Arthur was seriously attacked in August 2024 and is still recovering.
NMUS (New Mexicans for Utility Safety) file a Notice of Appeal in the Supreme Court of the State of New Mexico:
We have hired a lawyer, Helen Bennett, to take us to the New Mexico Supreme Court. Here in New Mexico, we still have a chance to shine a light on the global destruction being wrought by wireless technology. We still have a chance to set a precedent for the world here because New Mexico is the last state in the U.S. to approve smart meters, and unlike cell towers there is no law prohibiting states from banning smart meters on the basis of their health and environmental effects.
The New Mexico Public Regulation Commission (NMPRC) approved smart meters on October 17, 2024. We are preparing to file a Notice of Appeal in the New Mexico Supreme Court on January 8, 2025. Our strong grounds for appeal are contained in this short document, Motion for Rehearing, which we filed on November 18, and which the NMPRC ignored.

Motion of Rehearing excerpt:
"The Public Regulation Commission’s complete refusal to evaluate the health and environmental effects of smart meters is unlawful, unjust, and unreasonable. The Commission’s threat to fine NMUS up to $100,000 for continuing to urge the Commission to fulfill its mandate to protect the public health and welfare is likewise unlawful, unjust, and unreasonable."
A smart meter is a great digital upgrade from your old electricity meter and you can receive information about how and when you use electricity.

Cell Phone Taskforce testimonies about smart meters
Some of the 271 worldwide testimonies about the effects of Radiofrequency Microwave Radiation Emissions from Smart Meters:
Maryann McCabe writes from the UK: “From the time [the smart meter] was turned on, I could not walk around in my flat, I could not write an email, I could not think and I could not sleep. It was an absolute nightmare until it was switched off.”
Harriet Greene, formerly of New Mexico, writes: “I was able to opt out and keep my old meter. Everybody I talk to who was forced to accept smart meters has complained of numerous effects.”
Lauren Bond writes, “Smart meters were installed in my building, and the radiation they emit inside apartments creates for myself, a constant burning pain to my skin.”
Jeanne Thompson writes from California: “My mother died of a massive brain tumor caused by a row of six Smart Meters outside her condo, on the wall where the head of her bed was. We discovered this after she had already passed. You can imagine my shock and horror at that realization.”
Dr. Linda Thomas writes, “I have seen hideous debility in adults and children secondary to Smart Meters being installed in my area.” These include absence seizures in a 2-year-old boy and chronic fatigue and fibromyalgia in his mother.
Mario Desira writes from Malta: “Back in 2017 my electrical meter caught fire and nearly caused a house fire. Luckily I was at home and intervened before anything worse happened.”
Persephone Maywald writes from California that she was diagnosed with suspected Parkinson’s disease a few months after a smart meter was installed, and that she later had the meter replaced and within a few weeks all her symptoms disappeared.
Simone St. Clare writes from California that since a smart meter was installed, there have been almost no hummingbirds at her feeders and a decrease in caterpillars in her garden.
Deirdre Novella writes from New York that her hair started falling out within a few months of a smart meter being installed at her place of work, that she was diagnosed with leukemia, and that she developed a lifelong allergy to electricity.
Sheila Reavill, who works as an electromagnetic radiation specialist (“EMRS”) in Georgia, writes that after smart meters were installed, “the smart meter signature I logged [on her radio frequency meter] in my bedroom was at the precise times I wake up at night”; that her next door neighbor and her neighbor’s daughter wake at the exact same time she does every night; that her border collie began having skin problems and would wake up whimpering at the exact same time also; and that she and her dog both wake up at that same time with diarrhea.
Rebeca Randle writes from California that while she had a smart meter she could not sleep and there were no birds; and that when the smart meter was removed, the birds came back.
Robert Workman, an EMRS in Missouri, writes: “I have confirmed injuries from wireless radiation and the Smart meter seems to be the most damaging to me and my clients. Once the ITRON electronic meter is removed many of my clients have an immediate response to an improved health. This meter has been torture to myself and others in St Louis, it is my professional opinion this meter kills all biological life.”
Health practitioner Diane Peterson writes from California that “For the majority [of people], they suddenly developed symptoms and only later discovered that the symptoms began immediately after the smart meter was installed.”
Sema Kelly writes: “My friend’s neighbor had a smart meter put in. She didn’t know it had such dangers, but soon found out her chickens in the yard had huge tumors growing on their throats and body. The eggs they laid were odd shapes and colors, and the chickens appeared to be tired, which was not ever seen prior to the installments of the smart meters.”
Andre Fayolle writes that a smart meter gave his family headaches, caused the animals, birds and insects to disappear, and caused a fire that burned down his house.

Assessment of Radiofrequency Microwave Radiation Emissions from Smart Meters
Written by SAGE Associates – Environmental Consultants
(This report reference California but all countries who have signed up to SMART cities receive the same information from the WEF.)
How Smart Meters Work
This report is limited to a very simple overview of how smart meters work, and the other parts of the communication system that are required for them to transmit information on energy usage within a home or other building. The reader can find more detailed information on smart meter and smart grid technology from numerous sources available on the Internet. Often called ‘advanced metering infrastructure or AMI’, smart meters are a part of an overall system that includes a) a mesh network or series of wireless antennas at the neighborhood level to collect and transmit wireless information from all the smart meters in that area back to a utility.
The mesh network (sometimes called a distributed antenna system) requires wireless antennas to be located throughout neighborhoods in close proximity to where smart meters will be placed. Often, a municipality will receive a hundred or more individual applications for new cellular antenna service, which is specifically to serve smart meter technology needs. The communication network needed to serve smart meters is typically separate from existing cellular and data transmission antennas (cell tower antennas). The mesh network (or DAS) antennas are often utility-pole mounted. This part of the system can spread hundreds of new wireless antennas throughout neighborhoods.
Smart meters are a new type electrical meter that will measure your energy usage, like the old ones do now. But, it will send the information back to the utility by wireless signal (radiofrequency/microwave radiation signal) instead of having a 3 utility meter reader come to the property and manually do the monthly electric service reading. So, smart meters are replacements for the older ‘spinning dial’ or analog electric meters. Smart meters are not optional, and utilities are installing them even where occupants do not want them.
In order for smart meters to monitor and control energy usage via this wireless communication system, the consumer must be willing to install power transmitters inside the home. This is the third part of the system and involves placing power transmitters (radiofrequency/microwave radiation emitting devices) within the home on each appliance. A power transmitter is required to measure the energy use of individual appliances (e.g., washing machines, clothes dryers, dishwashers, etc) and it will send information via wireless radiofrequency signal back to the smart meter. Each power transmitter handles a separate appliance. A typical kitchen and laundry may have a dozen power transmitters in total. If power transmitters are not installed by the homeowner, or otherwise mandated on consumers via federal legislation requiring all new appliances to have power transmitters built into them, then there may be little or no energy reporting nor energy savings.
Smart meters could also be installed that would operate by wired, rather than wireless means. Shielded cable, such as is available for cable modem (wired internet connection) could connect smart meters to utilities. However, it is not easy to see the solution to transmit signals from power transmitters (energy use for each appliance) back to the utility.
Collector meters are a special type of smart meter that can serve to collect the radiofrequency/microwave radiation signals from many surrounding buildings and 4 send them back to the utility. Collector meters are intended to collect and retransmit radiofrequency information for somewhere between 500-5000 homes or buildings. They have three operating antennas compared to two antennas in regular smart meters. Their radiofrequency microwave emissions are higher and they send wireless signal much more frequently. Collector meters can be place on a home or other building like smart meters, and there is presently no way to know which a homeowner or property owner might receive.
Mandate
The California Public Utilities Commission has authorized California’s investor owned utilities (including Pacific Gas & Electric, Southern California Edison Company and San Diego Gas & Electric) to install more than 10 million new wireless* smart meters in California, replacing existing electric meters as part of the federal SmartGrid program.
The goal is to provide a new residential energy management tool. It is intended to reduce energy consumption by providing computerized information to customers about what their energy usage is and how they might reduce it by running appliances during ‘off-time’ or ‘lower load’ conditions. Presumably this will save utilities from having to build new facilities for peak load demand. Utilities will install a new smart meter on every building to which electrical service is provided now. In Southern California, that is about 5 million smart meters in three years for a cost of around $1.6 billion dollars. In northern California, Pacific Gas & Electric is slated to install millions of meters at a cost of more than $2.2 billion dollars. If consumers decide to join the program (so that appliances can report energy 5 usage to the utility), they can be informed about using energy during off-use or low-use periods, but only if consumers also agree to install additional wireless power transmitters on appliances inside the home. Each power transmitter is an additional source of pulsed RF that produces high exposures at close range in occupied space within the home.
“Proponents of smart meters say that when these meters are teamed up with an in-home display that shows current energy usage, as well as a communicating thermostat and software that harvest and analyze that information, consumers can see how much consumption drives cost -- and will consume less as a result. Utilities are spending billions of dollars outfitting homes and businesses with the devices, which wirelessly send information about electricity use to utility billing departments and could help consumers control energy use.” Wall Street Journal, April 29, 2009.
The smart meter program is also a tool for load-shedding during heavy electrical use periods by turning utility meters off remotely, and for reducing the need for utility employees to read meter data in the field.

The above is the best description of Smart Meters and the Smart Grid that we have seen. This is an excerpt from a much longer paper available here: http://sagereports.com/smart-meter-rf/.
Please note: In this paper the assertion is made that Smart Meters may expose people to levels of radiation that exceed the FCC’s exposure limits. This assertion is based on an assumption of 100% duty cycle (i.e., that the meters are broadcasting all of the time). In the real world, this is not accurate. The reason that Smart Meters are causing so much harm is not necessarily related to the amount of power they put out. We cannot emphasize too strongly that the FCC’s exposure limits have no validity. These limits only prevent thermal (heating) injury. Non-thermal effects are not necessarily related to power levels.
